We sell and ship exclusively within the United States. This policy is designed to comply with the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA), the Colorado Privacy Act (CPA), the Virginia Consumer Data Protection Act (VCDPA), the Connecticut Data Privacy Act (CTDPA), the Texas Data Privacy and Security Act (TDPSA), and all other applicable U.S. state privacy laws currently in effect.

1. Information We Collect

Information you provide directly:

  • Name, email address, phone number, and shipping/billing address when you place an order or create an account.
  • Payment information (credit card number, expiration date, CVV) when you make a purchase. Payment information is processed securely by Shopify Payments and is not stored on our servers.
  • Communications you send to us via email or our contact form.
  • Your name, email address, and phone number when you subscribe to our email or SMS marketing lists.

Information collected automatically:

  • Device information (browser type, operating system, device identifiers).
  • IP address and approximate geographic location.
  • Pages visited, time spent on pages, referring URLs, and click behavior on our website.
  • Cookie identifiers and pixel data collected through our website and advertising platforms.

Information collected from third parties:

  • Purchase and browsing behavior data processed through our server-side tracking providers (Elevar and Triple Whale) for advertising attribution and analytics.
  • Ad interaction data from advertising platforms (Meta Ads, Google Ads, Pinterest) when you click on or view our advertisements.

2. How We Use Your Information

We use the personal information we collect for the following purposes:

  • Order Fulfillment: To process and ship your orders, manage subscription renewals, send order confirmations, shipping notifications, and pre-renewal reminders.
  • Customer Support: To respond to your inquiries, process returns, and resolve issues.
  • Marketing Communications: To send you promotional emails and SMS messages about our products, offers, and content through Klaviyo. You may opt out at any time (see Section 7).
  • Advertising: To deliver targeted advertisements on Meta (Facebook/Instagram), Google, and Pinterest based on your browsing and purchase behavior, and to measure the effectiveness of those advertisements.
  • Analytics and Attribution: To understand how customers find and interact with our website, measure advertising performance, and improve our marketing through server-side tracking via Elevar and Triple Whale.
  • Subscription Management: To manage your subscription through Loop Subscriptions, process recurring charges, send renewal reminders, and enable you to skip, pause, or cancel your subscription.
  • Fraud Prevention and Security: To detect and prevent fraudulent transactions and protect the security of our website and your account.
  • Legal Compliance: To comply with applicable laws, regulations, and legal processes.

3. How We Share Your Information

We do not sell your personal information for monetary consideration. However, under certain state privacy laws (including the CCPA/CPRA), sharing personal information with advertising partners for targeted advertising may be considered a "sale" or "sharing" of personal information. You have the right to opt out of this activity (see Section 7).

We share your personal information with the following categories of third parties, and only for the purposes described:

Service Providers (who process data on our behalf):

  • Shopify: Ecommerce platform, hosting, and payment processing.
  • Loop Subscriptions: Subscription management, recurring billing, and customer portal.
  • Klaviyo: Email marketing, SMS marketing, and customer segmentation.
  • Elevar: Server-side tracking and data layer management for analytics and advertising attribution.
  • Triple Whale: Server-side tracking, analytics, and advertising attribution.

Advertising Partners (who may receive data for targeted advertising):

  • Meta (Facebook/Instagram): We share purchase events, browsing behavior, and hashed customer identifiers with Meta for ad targeting, retargeting, and conversion measurement.
  • Google Ads: We share purchase events and browsing behavior with Google for ad targeting and conversion measurement.
  • Pinterest: We share purchase events and browsing behavior with Pinterest for ad targeting and conversion measurement.

Each of these advertising partners may use the information they receive to serve you targeted ads across their platforms. This activity may constitute "sharing" under the CCPA/CPRA or "targeted advertising" under other state privacy laws. You may opt out at any time (see Section 7).

We may also disclose your information if required by law, in response to a valid legal process, or to protect our rights, property, or safety.

4. Cookies and Tracking Technologies

We use cookies, pixels, and server-side tracking technologies to collect information about your activity on our website. These include:

  • Essential Cookies: Required for our website to function (cart, checkout, account login). These cannot be disabled.
  • Analytics Cookies: Used to understand how visitors interact with our website, including page views, session duration, and navigation patterns.
  • Advertising Cookies and Pixels: Used by Meta, Google, and Pinterest to deliver and measure targeted advertisements. These cookies track your browsing behavior on our site and may follow you across other websites for retargeting.
  • Server-Side Tracking: Elevar and Triple Whale process certain events (page views, add-to-cart, purchases) server-side, meaning this data is sent directly from our server to advertising and analytics platforms rather than solely through your browser. This tracking operates independently of browser cookie settings.

You can manage your cookie preferences through your browser settings. However, because we use server-side tracking, disabling browser cookies alone may not prevent all data collection. To fully opt out of data sharing for advertising, please use the methods described in Section 7.

5. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes described in this policy, including:

  • Order and transaction data: Retained for at least 7 years for tax, accounting, and legal compliance purposes.
  • Subscription data and proof of consent: Retained for at least 3 years after the end of your subscription, or 1 year after cancellation, whichever is longer, in compliance with California's Automatic Renewal Law.
  • Marketing data (email, SMS): Retained until you unsubscribe or request deletion. Suppression records (proof that you opted out) are retained indefinitely to ensure we do not re-contact you.
  • Analytics and advertising data: Retained according to the policies of each respective platform (Meta, Google, Pinterest, Elevar, Triple Whale). We do not control retention periods for data held by third-party platforms.
  • Customer support communications: Retained for up to 3 years after your last interaction.

When personal information is no longer needed, we delete or anonymize it in accordance with applicable law.

6. Your Privacy Rights

Depending on your state of residence, you may have some or all of the following rights regarding your personal information. We honor these rights for all U.S. customers regardless of state, to the extent commercially practicable.

Right to Know / Access: You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the sources of that information, the purposes for which it was collected, and the categories of third parties with whom it was shared.

Right to Delete: You have the right to request that we delete the personal information we have collected from you, subject to certain legal exceptions (such as completing a transaction, detecting fraud, or complying with a legal obligation).

Right to Correct: You have the right to request that we correct inaccurate personal information we maintain about you.

Right to Opt Out of Sale/Sharing: You have the right to opt out of the sale or sharing of your personal information for targeted advertising purposes. See Section 7 for how to exercise this right.

Right to Limit Use of Sensitive Personal Information: Under the CCPA/CPRA, if we collect sensitive personal information, you have the right to limit our use and disclosure of that information. We do not currently collect sensitive personal information beyond what is necessary to process your transactions (such as payment card information).

Right to Data Portability: You have the right to receive your personal information in a portable, readily usable format.

Right to Non-Discrimination: We will never discriminate against you for exercising any of your privacy rights. We will not deny you goods or services, charge you different prices, or provide you with a different level of service because you exercised a privacy right.

Right to Appeal: If we deny your privacy request, you have the right to appeal our decision. To appeal, contact us at hello@lejardinswitzerland.com with the subject line "PRIVACY APPEAL." We will respond to your appeal within the timeframe required by applicable law. If your appeal is denied, you may contact your state's Attorney General to file a complaint.

7. How to Exercise Your Rights

Submitting a Request

You may submit a request to know, delete, correct, or exercise any other privacy right by:

We will verify your identity before processing your request. Verification may require you to confirm information associated with your account such as your name, email address, and order history. We will respond to verifiable requests within 45 days. If we need additional time, we will notify you of the extension and the reason for it.

You may designate an authorized agent to submit a request on your behalf. We may require the agent to provide proof of authorization and may still verify your identity directly.

Opting Out of Sale/Sharing and Targeted Advertising

To opt out of the sharing of your personal information for targeted advertising purposes:

  • Global Privacy Control (GPC): We honor GPC signals sent by your browser. If your browser transmits a GPC signal, we will treat it as a valid opt-out request for the sale and sharing of your personal information.
  • Email: Send a request to hello@lejardinswitzerland.com with the subject line "DO NOT SELL OR SHARE MY INFORMATION."
  • On-Site: Click the "Do Not Sell or Share My Personal Information" link in our website footer.

Opting Out of Marketing Communications

  • Email Marketing: Click the "Unsubscribe" link at the bottom of any marketing email from Le Jardin Switzerland. Your unsubscribe request will be processed by Klaviyo within 10 business days.
  • SMS Marketing: Reply STOP to any text message from Le Jardin Switzerland. Your opt-out will be processed immediately. Message and data rates may apply.

Opting out of marketing communications does not affect transactional messages such as order confirmations, shipping notifications, and subscription renewal reminders.

8. Do Not Sell or Share My Personal Information

Under the CCPA/CPRA and other applicable state laws, you have the right to opt out of the "sale" or "sharing" of your personal information. As described in Section 3, we share browsing behavior, purchase events, and hashed identifiers with advertising platforms (Meta, Google, Pinterest) for targeted advertising. This may constitute a "sale" or "sharing" under certain state privacy laws.

To opt out, use any of the methods described in Section 7. Once you opt out, we will cease sharing your personal information with advertising partners for targeted advertising purposes. Please note that opting out does not prevent us from using your data internally for analytics or from sending you transactional communications related to your orders or subscriptions.

We do not knowingly sell or share the personal information of consumers under the age of 16.

9. Children's Privacy

Our website and products are not directed at children under the age of 16. We do not knowingly collect personal information from children under 16. If we become aware that we have collected personal information from a child under 16, we will take steps to delete that information promptly. 10. Security

We implement reasonable administrative, technical, and physical security measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. Payment information is encrypted during transmission using industry-standard SSL/TLS protocols and is processed by Shopify Payments in compliance with PCI DSS standards.

No method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your personal information, we cannot guarantee its absolute security.

Our website may contain links to third-party websites or services that are not owned or controlled by Le Jardin Switzerland. We are not responsible for the privacy practices of these third parties. We encourage you to review the privacy policies of any third-party website you visit.

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors.
